A Tale of Two Policies Regulation vs Deregulation

The national debate over AI governance is sharply defined by two diametrically opposed executive orders, each representing a different philosophy on managing innovation. In 2023, the Biden administration’s Executive Order 14110, titled “Safe, Secure, and Trustworthy Development and Use of AI,” established a comprehensive framework centered on risk mitigation. This directive emphasized rigorous evaluation of AI systems, the promotion of equitable development, and a commitment to responsible innovation to safeguard the public interest. However, this cautious approach was abruptly reversed in January 2025 by the Trump administration’s Executive Order 14179, “Removing Barriers to American Leadership in AI.” This new directive signaled a major policy realignment, designed to slash regulatory hurdles and fast-track infrastructure development to secure America’s competitive edge. This pro-growth, anti-regulation stance finds support among some industry titans, who argue for “sensible regulation” that avoids stifling progress, yet critics contend that the rapidly escalating dangers posed by advanced AI demand a robust and centralized federal response, not a retreat from oversight.

The Digital Battlefield AI and Political Disinformation

One of the most immediate and tangible threats to the nation’s stability is the weaponization of artificial intelligence to manipulate democratic processes and erode public trust. The widespread availability of AI-powered tools for generating content, particularly hyper-realistic deepfakes, provides malicious actors and political operatives with an unprecedented ability to fabricate convincing but false narratives. These can be deployed to mislead voters, discredit opponents, and push specific agendas with alarming speed and scale. A stark example of this threat emerged during the 2024 Indonesian election, where a deepfake video of the late dictator Suharto was circulated to endorse a political party’s candidates, illustrating how easily such technology can influence an electorate. In response to this growing menace, twenty-four U.S. states have enacted legislation requiring campaign advertisements using AI-generated content to include a disclosure. However, to ensure a uniform standard of transparency and foster a well-informed citizenry across the country, experts argue that such legislation must be adopted at the federal level to create an unassailable line of defense for electoral integrity.

Cyber Warfare Unleashed AI as a Weapon

Beyond the political sphere, artificial intelligence is significantly amplifying the capabilities of malicious actors in cyberspace, enabling them to orchestrate more potent and sophisticated attacks. These AI-enhanced cyberattacks can automate the process of discovering system vulnerabilities, allowing criminals to breach secure networks, steal vast sums of currency, and disrupt or destroy critical infrastructure on a scale previously unimaginable. The severity of this threat was highlighted in a scenario from August 2025, where a cybercriminal reportedly used Anthropic’s Claude Code AI to successfully hack and extort seventeen companies, including a defense contractor and a major healthcare institution. This breach resulted in the theft of highly sensitive personal data, from social security numbers to private health information. As a legislative countermeasure, a bipartisan bill known as the Cyber Conspiracy Modernization Act was introduced by Senators Mike Rounds and Kirsten Gillibrand. The proposed legislation seeks to create a far stronger deterrent by dramatically increasing the penalties for cybercrimes, with potential sentences ranging from ten years to life in prison, reflecting the gravity of the offense.

The Ethical Dilemma of Autonomous Weapons

As military applications of AI continue to advance, grave concerns are mounting over the potential development of Lethal Autonomous Weapons Systems (LAWS), which are weapon systems capable of independently identifying, targeting, and neutralizing threats without direct human control. The deployment of such technology introduces profound security and ethical challenges. A primary threat is the risk of misidentification, where an autonomous system could mistakenly target civilians or friendly forces, an act that would constitute a war crime under international law. Furthermore, the use of LAWS creates a deep and unresolved crisis of accountability. When an autonomous weapon makes a fatal error, it remains unclear whether legal and moral responsibility lies with the system’s software designers, the manufacturers who produced it, or the military commanders who deployed it. Although the United States has not currently deployed fully autonomous weapons, the relentless pace of innovation in military AI has ignited a critical and urgent debate about whether LAWS would ultimately be beneficial or deeply detrimental to the future of warfare and global stability.

The vigorous pursuit of American leadership in the global artificial intelligence field was a valid national objective, but it could not come at the expense of fundamental security. The administration’s executive order prioritizing deregulation represented a perilous shift away from the essential oversight that this transformative technology demanded. As AI capabilities continued to accelerate, it became clear that the United States had to adapt by implementing strong, comprehensive, and intelligent regulations to address the multifaceted threats of disinformation, cybercrime, and autonomous weaponry. In the end, the most crucial finding was that sensible and robust safety measures were never an impediment to progress; rather, they were an essential and co-equal priority for protecting the security and stability of the nation in an increasingly complex and unpredictable technological landscape.
